Pengasas Madzhab Al-Syafie ialah Muhammad bin Idris Al-Syafie. Beliau dilahirkan pada tahun 150 H, pada tahun yang sama dengan kewafatan ulama besar yang hebat iaitu Imam Abu Hanifah (pengasas Madzhab Hanafi). Sampai sebahagian orang mengatakan, "seorang imam telah meninggal dunia dan lahir pula seorang imam yang lain".
Menurut Dr. Ahmad Nahrawi Abdus Salam, Imam Al-Syafie dilahirkan di Gaza, Palestin. Desa Gaza ini berdekatan dengan sebuah kota yang dikenali sebagai 'Asqalan. Dan kebanyakan kabilah yang tinggal berhampiran dengan tempat lahir Imam Al-Syafie ini adalah orang-orang Yaman. Pendapat ini turut dibentangkan oleh Prof. Muhammad Abu Zahrah. Seorang pengkaji sejarah, Al-Himawi, berkata, "Pentakwilan ini bagus sekiranya riwayat-riwayat tersebut Sahih."

And most of the tribes who lived close to the birthplace of Imam Al-Syafie these are the people of Yemen. This opinion contributed outlined by Prof. Muhammad Abu Zahrah.
