Ushul fiqih (bahasa Arab:أصول الفقه) adalah ilmu hukum dalam Islam yang mempelajari kaidah-kaidah, teori-teori dan sumber-sumber secara terperinci dalam rangka menghasilkan hukum Islam yang diambil dari sumber-sumber tersebut. [1]

Sumber-sumber hukum islam[sunting | sunting sumber]
Mekanisme pengambilan hukum dalam Islam harus berdasarkan sumber-sumber hukum yang telah dipaparkan ulama. Sumber-sumber hukum islam terbagi menjadi 2, yaitu:
Sumber Hukum Primer juga terbagi menjadi 2, yaitu:
Al-Qur'an, kitab suci agama Islam
Sunnah, tindakan, ucapan dan ketetapan Nabi Muhammad
2. Sumber Hukum Sekunder
Ijma, kesepakatan para ulama.
Qiyas, analogi hukum dengan hukum lain yang telah ada ketetapannya.

Pada mulanya, para ulama terlebih dahulu menyusun ilmu fiqh sesuai dengan Al-Qur an, Hadits, dan Ijtihad para Sahabat. Setelah Islam semakin berkembang, dan mulai banyak negara yang masuk kedalam
daulah Islamiyah, maka semakin banyak kebudayaan yang masuk, dan menimbulkan pertanyaan mengenai budaya baru ini yang tidak ada di zaman Rosulullah. Maka para Ulama ahli usul Fiqh menyusun kaidah
sesuai dengan gramatika bahasa Arab dan sesuai dengan dalil yang digunakan oleh Ulama penyusun ilmu Fiqh [2]
Usaha pertama dilakukan oleh Imam Syafi'i dalam kitabnya Arrisalah. Dalam kitab ini ia membicarakan tentang Qur'an, kedudukan hadits, Ijma, Qiyas dan pokok-pokok peraturan mengambil hukum. Usaha Imam Syafi'i ini merupakan batu pertama dari ilmu ushul fiqih yang kemudian dilanjutkan oleh para ahli ushul fiqih sesudahnya. Para ulama ushul fiqih dalam pembahasannya mengenai ushul fiqih tidak selalu sama, baik tentang istilah-istilah maupun tentang jalan pembicaraannya. Karena itu maka terdapat dua golongan yaitu; golongan Mutakallimin dan golongan Hanafiyah.[3]
Golongan Mutakallimin dalam pembahasannya selalu mengikuti cara-cara yang lazim digunakan dalam ilmu kalam, yaitu dengan memakai akal-pikiran dan alasan-alasan yang kuat dalam menetapkan peraturan-peraturan pokok (ushul), tanpa memperhatikan apakah peraturan-peraturan tersebut sesuai dengan persoalan cabang (furu') atau tidak. Di antara kitab-kitab yang ditulis oleh golongan ini adalah;
Al-Mu'tamad oleh Muhammad bin Ali
Al-Burhan oleh Al-Juwaini
Al-Mustashfa oleh Al-Ghazali
Al-Mahshul oleh Ar-Razy
Golongan Hanafiyah dalam pembahasannya selalu memperhatikan dan menyesuaikan peraturan-peraturan pokok (ushul) dengan persoalan cabang (furu').
Setelah kedua golongan tersebut muncullah kitab pemersatu antara kedua aliran tersebut di antaranya adalah;
Tanqihul Ushul oleh Sadrus Syari'ah
Badi'unnidzam oleh As-Sa'ati
Attahrir oleh Kamal bin Hammam
Al-Muwafaqat oleh As-Syatibi
Selain kitab-kitab tersebut di atas, juga terdapat kitab lain yaitu, Irsyadul Fuhul oleh Asy-Syaukani, Ushul Fiqih oleh Al-Chudari. Terdapat juga kitab Ushul fiqih dalam bahasa Indonesia dengan nama
"Kelengkapan dasar-dasar fiqih" oleh Prof. T.M. Hasbi As-Shiddiqi.[3]

Making mechanisms in Islamic law should be based on the sources of law that have been described scholars. The sources of Islamic law are divided into two, namely:
Primary Sources of Law is also divided into two, namely:
Qur'an, Islam's holy book
Sunnah, actions, words and statutes of the Prophet Muhammad
2. Law Secondary Sources
Ijma, the consensus of the scholars.
Qiyas, legal analogy with other existing legal writ.

At first, the scholars of fiqh first compiled in accordance with the science of Al-Qur an, Hadith, and Ijtihad the Companions. After Islam is growing, and started a lot of countries that enter into
the Daulah Islamiyah, the more cultures that come in, and raises questions about the new culture that does not exist in the time of Muhammad. So the real experts Fiqh Ulama compiled in accordance
with the rules of grammar of the Arabic language and in accordance with the arguments used by authors of science Fiqh Ulama [2]
The first attempt made by Imam Shafi'i in his book Arrisalah. In this book he talks about the Qur'an, hadith position, consensus, and points Qiyas take legal regulations. Imam Shafi'i effort is the cornerstone of the science of usul fiqh which was then followed by experts usul fiqh afterwards. The scholars of usul fiqh in his discussion of usul fiqh is not always the same, either of the terms or on the conversation. Because that then there are two groups, namely; Hanafiyah mutakallimin groups and classes. [3]
Group mutakallimin in the discussion always follow the ways commonly used in theology, which used mind-thoughts and reasons of power in setting main rules (fiqh), regardless of whether these regulations in accordance with the issue of branches ( furu ') or not. Among the books written by this group are;
Al-Mu'tamad by Muhammad bin Ali
Al-Burhan Al-Juwaini
Al-Mustashfa by al-Ghazali
Al-Mahshul by Ar-Razy
