Pemilihan Umum merupakan perwujudan kedaulatan rakyat guna menghasilkan pemerintahan yang demokratis. Penyelenggaraan pemilu yang bersifat langsung, umum, bebas, rahasia, jujur dan adil hanya dapat terwujud apabila Penyelenggara Pemilu mempunyai integritas yang tinggi serta memahami dan menghormati hak-hak sipil dan politik dari warga negara. Penyelenggara Pemilu yang lemah berpotensi menghambat terwujudnya Pemilu yang berkualitas.
Sebagaimana diamanatkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Penyelenggara Pemilu memiliki tugas menyelenggarakan Pemilu dengan kelembagaan yang bersifat nasional, tetap dan mandiri.
Salah satu faktor penting bagi keberhasilan penyelenggaraan Pemilu terletak pada kesiapan dan profesionalitas Penyelenggara Pemilu itu sendiri, yaitu Komisi Pemilihan Umum, Badan Pengawas Pemilu, dan Dewan Kehormatan Penyelenggara Pemilu sebagai satu kesatuan fungsi penyelenggaraan Pemilu. Ketiga institusi ini telah diamanatkan oleh undang-undang untuk menyelenggarakan Pemilu menurut fungsi, tugas dan kewenangannya masing-masing.
Sehubungan dengan penyelenggaraan Pemilu Tahun 2009 yang belum berjalan secara optimal, maka diperlukan langkah-langkah perbaikan menuju peningkatan kualitas penyelenggaraan Pemilu. Perbaikan tersebut mencakup perbaikan jadwal dan tahapan serta persiapan yang semakin memadai. Berdasarkan hal tersebut, maka Undang-Undang Nomor 22 Tahun 2007 tentang Penyelenggara Pemilihan Umum perlu diganti.
